1. Platform Information & Support

The platform GENNIEZ provides an online promotional auction and retail shopping marketplace.

2. Eligibility & Account Registration

To use this platform and participate in auctions or store shopping, you must:

• Be at least 18 years of age and legally competent to enter into a binding contract under Indian law.
• Provide true, accurate, current, and complete personal and delivery details.
• Maintain the strict confidentiality of your login credentials. You are solely responsible for all activities and bids placed under your account.
• Maintain only one (1) account. Creating duplicate, dummy, or fraudulent accounts is strictly prohibited.

3. Nature of Service & Auction Legality in India

GENNIEZ is a legitimate e-commerce promotional marketplace offering live timed auctions and direct retail sales. GENNIEZ is NOT a lottery, gambling, betting, or game of chance.

• All items offered are authentic physical consumer goods.
• Auctions operate on transparent, predetermined rules where the auction clock and bid increments are visible to all participants in real time.
• Placing a bid is an active, affirmative commercial offer to purchase the specified item at the bid price if you are the concluding highest bidder.

4. Irrevocable Bidding Commitments & Winner Obligations

• Bids are Irrevocable: Once placed, a bid cannot be cancelled, reversed, or refunded under any circumstances.
• Winning Settlement: If the auction timer reaches zero (00:00) and you are declared the highest bidder, you are legally obligated to complete the checkout payment for the final winning price within forty-eight (48) hours.
• Default & Abandonment: Failure to settle the winning amount within 48 hours will result in forfeiture of the win, cancellation of the order, and potential permanent suspension of your account.

5. Fulfillment: Home Delivery & Self Store Pickup

• Home Delivery: Products will be dispatched to the verified shipping address provided at checkout via standard courier partners. Estimated delivery timeframe is 3–7 business days across India.
• Store Pickup (Self-Collection): If you select Store Pickup, you or your authorized nominee must collect the item from the designated hub at Butbhavani Enterprise, Kachhi Koloni, Deesa, Gujarat - 385535 within fourteen (14) calendar days of payment by showing the Order ID and valid Government Photo ID (Aadhaar Card / PAN / Driving License). Items uncollected after 30 days may be deemed abandoned.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO EVENT SHALL GENNIEZ, ITS OPERATORS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. THE AGGREGATE LIABILITY OF THE PLATFORM FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE DISPUTE.

7. User Indemnification

You agree to defend, indemnify, and hold harmless GENNIEZ and its operators from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) any fraudulent, malicious, or automated bot bidding activities; or (c) your infringement of any third-party rights.

8. Zero Bot & Anti-Fraud Policy

The use of automated scripts, web scrapers, bots, autoclickers, or reverse engineering tools to place bids or manipulate auctions is strictly illegal. Any attempt to tamper with the system will result in instant account termination, confiscation of any winning items, and immediate reporting to cybercrime law enforcement under Section 66 of the Information Technology Act, 2000.

9. Grievance Officer & Statutory Redressal

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and Consumer Protection (E-Commerce) Rules, 2020:

10. Governing Law & Exclusive Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India. You irrevocably agree that the competent courts located in Deesa / Banaskantha District, Gujarat, India shall have exclusive territorial and subject-matter jurisdiction to resolve any legal disputes or proceedings.
